{"id":2978,"date":"2026-03-09T09:33:20","date_gmt":"2026-03-09T09:33:20","guid":{"rendered":"https:\/\/sotpost.com\/?p=2978"},"modified":"2026-03-09T09:33:21","modified_gmt":"2026-03-09T09:33:21","slug":"veton-surroi-dekreti-i-6-marsit-per-shperndarjen-e-kuvendit-mund-te-jete-ne-kundershtim-me-kushtetuten","status":"publish","type":"post","link":"https:\/\/sotpost.com\/?p=2978","title":{"rendered":"Veton Surroi: Dekreti i 6 marsit p\u00ebr shp\u00ebrndarjen e Kuvendit mund t\u00eb jet\u00eb n\u00eb kund\u00ebrshtim me Kushtetut\u00ebn"},"content":{"rendered":"\n<p>Shkruan: Veton Surroi<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>Nj\u00eb sugjerim p\u00ebr interpretim t\u00eb mundsh\u00ebm t\u00eb dekretit t\u00eb 6 marsit p\u00ebr shp\u00ebrndarjen e Kuvendit.<\/p>\n\n\n\n<p>1.<br>Presidenti\/ja i\/e Kosov\u00ebs ka autorizime kushtetuese, t\u00eb p\u00ebrcaktuara shprehimisht, p\u00ebr t\u00eb shp\u00ebrndar\u00eb Kuvendin e Republik\u00ebs s\u00eb Kosov\u00ebs \u00a0n\u00eb tri raste: n\u00ebse nuk formohet Qeveria brenda 60 dit\u00ebve nga em\u00ebrimi i kandidatit p\u00ebr Kryeminist\u00ebr, n\u00ebse dy t\u00eb tretat e deputet\u00ebve votojn\u00eb p\u00ebr shp\u00ebrndarjen e Kuvendit dhe n\u00ebse Presidenti\/ja nuk zgjidhet brenda 60 dit\u00ebve nga fillimi i procedur\u00ebs p\u00ebr zgjedhjen e tij\/saj. K\u00ebtyre tri u shtohet edhe votimi i suksessh\u00ebm i mosbesimit t\u00eb Qeveris\u00eb. Asnj\u00eb nga k\u00ebto kushte nuk ishte p\u00ebrmbushur m\u00eb 6 mars, kur u shpall dekreti p\u00ebr shp\u00ebrndarjen e Kuvendit.<br>2.<br>Presidenti\/ja i\/e Kosov\u00ebs nuk ka kompetenc\u00eb diskrecionale p\u00ebr t\u00eb interpretuar kompetencat e veta p\u00ebrtej asaj q\u00eb p\u00ebrcakton Kushtetuta dhe p\u00ebr t\u00eb nd\u00ebrhyr\u00eb n\u00eb proceset e pushteteve t\u00eb tjera. Deklarimet p\u00ebr ekzistenc\u00ebn e nj\u00eb bllokimi institucional, p\u00ebr veprime t\u00eb \u201cnjer\u00ebzve t\u00eb pap\u00ebrgjegjsh\u00ebm me q\u00ebllime t\u00eb rrezikshme\u201d, apo p\u00ebr nj\u00eb detyrim t\u00eb pretenduar p\u00ebr t\u00eb vepruar n\u00eb mbrojtje t\u00eb rendit kushtetues, nuk krijojn\u00eb kompetenca t\u00eb reja kushtetuese dhe nuk mund t\u00eb z\u00ebvend\u00ebsojn\u00eb kushtet e p\u00ebrcaktuara n\u00eb Kushtetut\u00eb p\u00ebr ushtrimin e nj\u00eb kompetence t\u00eb caktuar.<br>3.<br>Edhe n\u00eb rastin e gjendjes s\u00eb jasht\u00ebzakonshme, Presidenti nuk vepron i vet\u00ebm: dekreti i dakorduar me Kryeministrin anulohet n\u00ebse nuk miratohet nga Kuvendi brenda 48 or\u00ebsh. Kosova nuk \u00ebsht\u00eb n\u00eb gjendje t\u00eb jasht\u00ebzakonshme dhe edhe sikur t\u00eb ishte, veprimet e Presidentit mbeten t\u00eb kufizuara nga kontrolli kushtetues i Kuvendit.<br>4.<br>Kompetenca p\u00ebr shp\u00ebrndarjen e Kuvendit \u00ebsht\u00eb nj\u00eb nga kompetencat m\u00eb t\u00eb fuqishme n\u00eb sistemin kushtetues, sepse ajo nd\u00ebrpret mandatin e p\u00ebrfaq\u00ebsimit popullor, ndryshon rendin institucional dhe \u00e7on n\u00eb zgjedhje t\u00eb reja parlamentare. Ushtrimi i k\u00ebsaj kompetence pa u p\u00ebrmbushur kushtet kushtetuese p\u00ebrkat\u00ebse p\u00ebrb\u00ebn cenim t\u00eb drejtp\u00ebrdrejt\u00eb t\u00eb rendit kushtetues.<br>5.<br>Dekreti i shpallur m\u00eb 6 mars p\u00ebrb\u00ebn nd\u00ebrhyrje n\u00eb funksionimin e pushtetit legjislativ dhe n\u00eb \u00a0baraspesh\u00ebn institucionale t\u00eb p\u00ebrcaktuar nga Kushtetuta. Rrjedhimisht ka pritshm\u00ebri t\u00eb arsyeshme q\u00eb dekreti t\u00eb p\u00ebrcaktohet si akt n\u00eb kund\u00ebrshtim me Kushtetut\u00ebn.<br>6.<br>Duhet t\u00eb ket\u00eb poashtu pritshm\u00ebri t\u00eb arsyeshme q\u00eb deri n\u00eb nj\u00eb vler\u00ebsim kushtetues p\u00ebrfundimtar t\u00eb \u00a0pezullohet zbatimi i dekretit me mas\u00eb t\u00eb p\u00ebrkohshme nga Gjykata Kushtetuese e Republik\u00ebs s\u00eb Kosov\u00ebs.
